Should defendants of drunk driving cases have access to the breathalyzer source code? October 22, 2005

Posted by rjdohnert in Software reviews.

My answer. nope. making sure the breathalyzer has been recertified and recalbrated is one thing. The source code to see how it works is another. Whats a derfendant going to do? Blame an if-then-else statement on a machine with 98% accuracy rating as to why he downed 12 Budweisers and half a gallon of Tequila. Personally I dont see how viewing the source code is actually going to make a difference in the outcome of the trials? Whats next? Are they going to want to see the source code for the software they use to match DNA in a rape kit?
